Who we are

MineralCache, LLC (“MineralCache,” “we,” “us,” or “our”) operates a multi-vendor marketplace for minerals, fossils, crystals, gemstones, and related goods (the “Services”). Contact: info@mineralcache.com; MineralCache, LLC · P.O. Box 5, Llano, TX 78643, USA.

Agreement to these terms

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. You must be at least 18 years old to register or purchase. By using the Services, you agree that acceptance of these Terms by electronic means constitutes a legally binding agreement under applicable law.

Account & eligibility

• You agree to provide accurate information and keep it updated.
• You are responsible for all activity under your account and for safeguarding your credentials.
• We may suspend or terminate accounts that violate these Terms or applicable law.

Marketplace nature

• MineralCache operates as an online marketplace platform that facilitates transactions between independent sellers and buyers. Except as expressly stated, MineralCache is not the seller of items listed by third-party vendors and does not manufacture, store, or ship products.
• For payment processing purposes only, MineralCache may act as the merchant of record and process payments, refunds, and disputes on behalf of sellers through third-party payment providers. Sellers remain solely responsible for their listings, products, fulfillment, and compliance with applicable laws, as further described in the Vendor Terms & Listing Standards.
• MineralCache does not guarantee listing visibility, transaction volume, or availability of the Services without interruption.

Purchases

All purchases on MineralCache are expected to be made in good faith. By placing an order or participating in an auction, you agree that you intend to complete the transaction in accordance with these Terms and any applicable listing details.

Buy-It-Now Purchases

When placing a standard purchase, you agree to provide accurate payment and account information and to complete payment at the time of checkout. Orders may be reviewed or canceled in accordance with our policies, including cases involving suspected fraud, listing errors, or policy violations.

Auctions

• When you place a bid in an auction, you are entering into a binding commitment to purchase the item if you are the winning bidder.
• Winning bidders must complete payment within forty-eight (48) hours of the auction’s close. Auction wins are automatically added to the winner's cart for checkout.
• If payment is not received within this timeframe, the item may be removed from the winning bidder’s cart, the transaction may be canceled, and the item may be returned to the vendor’s inventory and made available to other buyers.
• MineralCache reserves the right to suspend bidding or purchasing privileges for repeated non-payment. If additional time is needed, the winning bidder must contact us before the payment deadline to request invoice arrangements, which may be granted at our discretion.
• Failure to complete payment within this timeframe may result in: Cancellation of the transaction, loss of bidding or purchasing privileges, temporary or permanent suspension of your account.

Auction Integrity

Any attempt to manipulate the auction process—including, but not limited to, shill bidding, bid retraction abuse, false accounts, or interference with other bidders—may result in immediate action. This may include cancellation of bids, suspension or termination of accounts, and restriction from future participation on the platform.

Enforcement

MineralCache reserves the right to take appropriate action to protect the integrity of the marketplace, its vendors, and its users, including refusing service or restricting access for violations of these Terms.

Products, pricing, and availability

• We strive for accuracy, but color, size, and appearance may vary based on photography and displays.
• Prices and availability are set by sellers and may change at any time. Errors may be corrected.
• Orders may be refused or canceled within twenty-four (24) hours of purchase if there is suspected fraud, pricing errors, restricted items, or policy violations. Charges already paid will be refunded if canceled before fulfillment.

Payments, taxes, and shipping

• Payments are processed by third-party providers (e.g., Stripe). You authorize charges to your selected method.
• Applicable taxes and shipping charges are shown at checkout. MineralCache may collect and remit sales or similar transaction taxes in jurisdictions where it is required to do so as a marketplace facilitator. Tax treatment may vary by location.
• Available shipping services and estimated delivery timeframes are presented at checkout based on the selected destination and carrier options. Vendors remain responsible for timely dispatch and proper packaging of orders. Title and risk of loss transfer upon confirmed carrier delivery to the address provided at checkout, unless otherwise required by law.

Refunds, disputes, and chargebacks

MineralCache may process refunds, disputes, and chargebacks through its payment providers in accordance with applicable policies. Sellers are financially responsible for seller-caused refunds, disputes, chargebacks, reversals, and related fees, as described in the Vendor Terms. MineralCache may recover such amounts by offsetting future payouts or other lawful means.

Returns and refunds

Unless otherwise stated in a listing, return eligibility is governed by the Returns & Refunds Policy. Review the listing and our return guidance before purchasing. See our Returns & Refunds Policy in the Legal section.

Acceptable use

• Do not engage in fraud, harassment, infringement, scraping, or security abuses.
• Do not upload malware or interfere with the operation of the Services.
• Do not attempt to circumvent access controls or misuse others’ data.
• Comply with all applicable laws and sanctions rules.

Intellectual property

• The Services’ software, design, text, and graphics are owned by MineralCache or its licensors.
• Vendors retain rights in their listings and media but grant MineralCache a non-exclusive, worldwide, royalty-free license to host and display that content in connection with the Services.
• You may not copy, modify, distribute, or create derivative works except as permitted by law or with consent.

Privacy

Your use of the Services is governed by our Privacy Policy.

Disclaimer

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not control third-party sellers and are not responsible for their statements or conduct.

Limitation of liability

To the fullest extent permitted by law, MineralCache, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or related to the Services. MineralCache’s total aggregate liability for any claim shall not exceed the amounts paid to MineralCache by the claimant in the six (6) months preceding the event giving rise to the claim.

Sellers Indemnification

Sellers agree to indemnify, defend, and hold harmless MineralCache, LLC from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to the Seller’s listings, products, services, representations, conduct, or violation of applicable law.

Termination

We may suspend or terminate access to the Services at any time for any reason, including violations of these Terms. You may stop using the Services at any time.

Disputes; governing law

• These Terms are governed by the laws of the State of Texas, without regard to conflicts of law.
• Before filing a claim, the parties will try in good faith to resolve disputes informally for 30 days after written notice.
• Except where prohibited, disputes will be resolved by binding arbitration in Travis County, Texas, on an individual basis; no class actions. Either party may bring qualifying claims in small-claims court.
• Any claim must be brought within one (1) year after it arises.

Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on the Services and, where required, we will notify you. Continued use after the effective date constitutes acceptance.

Miscellaneous

• These Terms, together with policies referenced here (including Privacy, Cookies, and Vendor Terms & Listing Standards) form the entire agreement between you and MineralCache regarding the Services.
• If any provision is found unenforceable, the remaining provisions will remain in full force.
• We may assign our rights and obligations; you may not assign without our consent.
• If you are a seller, the Vendor Terms & Listing Standards apply in addition to these Terms. In the event of any conflict between the Vendor Terms and these Terms, the Vendor Terms shall control with respect to seller-specific matters.
• Sections relating to payments, refunds, chargebacks, limitation of liability, indemnification, dispute resolution, and governing law shall survive termination of these Terms.
